With the passage of time, the law and legal institutions evolve, therefore, they deserve new discussions, in relation to legal sociology, for the full validity of rights. Meanwhile, the investigation emerges from the identification of a phenomenon, in our case the police function which has been little studied. Due to the above, it has been established as a general objective to analyze how the police function affects the personal freedom of those intervened in national emergencies, a situation that makes possible new findings, this by virtue of the collection of information from documentary sources; which led us to the result and conclusion that indeed the police function generates certain disagreements that make its peaceful acceptance in society unfeasible. This is not only a legal institution problem, but there is also a lack of training for the police officers who carry out the aforementioned procedure. Given this, it is pertinent to highlight that the need for the existence of said police procedure is not being questioned, but the way in which it is carried out, since police abuses go unpunished in many of the cases, and in others it becomes a practice whimsical devoid of normative parameters. For this reason, it is prudent to promote the production of information that makes it possible to denounce any act that constitutes police abuse or incidentally those that imply the violation of human rights.
