The objective was to analyze the legal regulation of the tacit consent of a cadaveric donor and ensure the right to health through the state of the art. It is of basic type and qualitative approach, a documentary analysis was carried out, through a bibliographic review, the search for information was obtained from publications indexed in Latin America and Europe in the databases of Ebsco, Scopus, Scielo, Redalyc and Dialnet, during the period 2016 to 2023. Little implementation of public policies that help privilege the presumed consent of cadaveric donor in safeguarding public health. Conclusion, the presumed consent of a cadaveric donor counteracts the high demand for organs and the responsibility of the State in the right to public health, in addition, there is still opposition from their families, despite the tacit consent of the donor in order to provide a quality of life to the recipient of the donation.
