The present study with the objective of analyzing the non-contractual state civil liability in cases of contagion of diseases by infected blood transfusions in state health institutions, with a qualitative methodology of propositive legal analysis, had as results the identification of the subjects involved, the The obligation of security and diligence of the State Health Institution was determined, the responsibility of health professionals in the detection and prevention of infected blood transfusions was evaluated. Likewise, the existing measures in the health institutions to avoid contagion by infected blood transfusions were exposed and proposals were presented to strengthen them.
