The study aimed to identify the causes, consequences and alternatives to one of the main judicial and penitentiary problems in the country: the crime of omission of family assistance. In a country with a low level of culture of legality and respect for fundamental rights, with a significant presence of dysfunctional and broken families, the omission of family assistance is nothing more than an expression of this social and family decomposition with enormous legal and judicial effects, with the most vulnerable: children, adolescents, women. From a qualitative approach, applying the technique of documentary source analysis (casuistry, legislation, doctrine) the phenomenon is described from the hermeneutic and systematic method that allows us to glimpse the problematic scenario. It is evident that the State has been ineffective in the formation and valuation of the culture of legality, so that in addition to implementing jurisdictional measures, educational policies oriented to the integral formation of citizenship are required.
