The objective of the study was to analyze sexual harassment in the work environment and the damage caused to workers’ rights, which is considered a type of gender-based violence that is on the rise. The qualitative and interpretative method was used, based on inquiry, study of scientific production, choosing terms of “Sexual harassment, Sexual harassment, Fundamental rights”, leaving aside documents that are not in Spanish, and disseminated years ago and available in the data of Scopus, Scielo and Redalyc free of charge and in Spanish. From the analysis and discussion of each of the articles, it was shown that sexual harassment in the workplace and the damage caused to the rights of workers is a social problem worldwide, since these expressions of violence are perceived by women, in the workplace, studies, and should be addressed by our authorities, implementing public policies to identify, punish and eliminate all topes of violence and inequalities that damage and violate rights. It was shown that sexual harassment in the workplace and the damage caused to the rights of workers is of concern to society as it violates the rights of individuals and affects the victim in the work development, seeking its eradication and punishment according to the damage caused.
