The present article proposes a bibliographic review paradigm designed to prevent negligence in all medical procedures, while also seeking to delve deeper into the effectiveness and efficiency of medical professional practices. With regard to the methodology employed, the focus is on the collection, analysis and interpretation of available data, as well as contributions from conferences and specialised training courses in medicine, medical law and the medical practice itself, as well as a review of medical terminology. In summary, the following premises emerge, which support the imperative need to generate active awareness of rigorous adherence to the protocols governing medical practices, knowledge of guidelines on good medical practices, current legal regulations, and jurisprudence on the subject. The present study sets out to demonstrate the urgent need to apply the Lex artis ad hoc in order to comply with professional duties, namely prevention, diligence, prudence, expertise, and care. In order to inform the patient about the risks and limits of the procedure, patient autonomy must be addressed, and the fundamental bioethical principles of non-maleficence, beneficence, autonomy, and justice must be applied. The concept of medical malpractice (due to omission or commission), the establishment of a causal link in cases of negligence (damage, harmful act, imputation), and the significance of authorisation of healthcare facilities (with RENIPRESS code and registered with SUSALUD), the possession of adequate equipment, and rigorous sterilisation processes (e.g. use of an autoclave) are also analysed. It is concluded that the prevention of medical malpractice requires a comprehensive approach that encompasses everything from ethical conduct and professional expertise to compliance with health regulations and proper resource management. This demonstrates the fundamental interconnection between law, ethics, and medicine to ensure quality care and respect for life, thereby minimizing adverse events and legal implications.
