The present study seeks to show reality for improvement, to prevent more children and adolescents from continuing to grow up in the absence of their parents, to prevent their small lives from continuing to be marked by this abandonment at a very early age, to raise awareness among adults. , to the State more emphasis on public policies on the well-being of children and adolescents. This study is qualitative because it aims to use an exploratory approach to the phenomenon under investigation. Also, it is retrospective and transversal. As this is a review article, the units of study consist of published bibliographies placed in perspective. The data collection method was the review of documents, which allowed the analysis and interpretation of the data obtained (previous surveys and data from state institutions), which were organized and systematized in tables and charts as part of the analysis. It is concluded that it is evidently necessary to modify the current Criminal Legislation in order to prevent the “Mistreatment of Minors” by sanctioning it as a crime; thus minimizing the long-term consequences of abuse.
